In July 2009 the Belt Line Railroad decides not to appeal the Superior Court decision that the City of Alameda had a valid contract and could buy the 40 acres including the switching yard and extensions. Thanks to the work of Jean & Jim Sweeney, the 22 acre switching yard will become an open space park.
On July 29, 2009 the community that supported Jean and Jim Sweeney through out the long process came together to celebrate where 9th Street dead ends at the Belt Line switching yard .
